Discrimination Suit Against Utility Co. Legit: Judge

Law360, New York (October 1, 2009, 4:14 PM EDT) -- A federal judge has denied a bid by Louisville Gas & Electric Co. to dismiss a racial discrimination suit brought by an employee who accused the company of passing him over for temporary supervisor shifts because he is black.

In the U.S. District Court for the Western District of Kentucky, Judge Jennifer Coffman determined that the utility's proffered nondiscriminatory reasons for selecting a similarly situated white employee to perform supervisor duties instead of plaintiff Edward O'Bannon would not be bought by a jury.
