Bra-Maker Seeks Boost From Supreme Court

Law360, New York (October 2, 2009, 6:46 PM EDT) -- Nursing bra-maker Glamourmom LLC is seeking to take its patent infringement case against Target Corp. and other major retailers to the U.S. Supreme Court, arguing the lower court failed to properly analyze the patent for obviousness.

In its petition for writ of certiorari, the company said the U.S. Court of Appeals for the Federal Circuit's decision to affirm a ruling holding the patent invalid for obviousness could render an entire class of “flash of genius” inventions unpatentable.
