PGE Clean Air Act Claims Not Time-Barred: Judge

Law360, New York (October 5, 2009, 1:06 PM EDT) -- A federal judge has found that Clean Air Act claims brought by the Sierra Club and other groups over a nearly 30-year-old coal-fired power plant in Oregon aren't barred by the federal five-year statute of limitations, mostly denying Portland General Electric Co.'s bid for summary judgment.

Judge Ancer L. Haggerty of the U.S. District Court for the District of Oregon rejected on Wednesday rejected PGE's argument that the CAA claims accrued 30 years ago when the utility company constructed the plant.
