American Family Loses En Banc Bid In $2.3M Fire Suit

Law360, New York (October 6, 2009, 2:52 PM EDT) -- A federal appellate court has refused to rehear American Family Mutual Insurance Co.'s appeal of a $2.3 million damages award in favor of a couple who sued the insurer for breach of contract after it denied a claim for fire coverage and accused one of them of arson.

The U.S. Court of Appeals for the Eighth Circuit denied American Family's petition for rehearing Friday, having already affirmed a decision awarding the couple $1.15 million in bad faith consequential damages and $1.15 million in punitive damages....
