Sierra Club Says It Will Sue W.Va. Over Coal Cleanup Funds

Law360 (May 11, 2020, 3:52 PM EDT) -- The Sierra Club and other environmental groups say they'll sue West Virginia regulators, claiming they violated federal law by failing to report that the state's fund for cleaning up abandoned coal mines might be at risk.

The groups' Friday notice of intent to sue said that the West Virginia Department of Environmental Protection is violating the Surface Mining Control and Reclamation Act by failing to tell federal officials about the budget problems — an issue only made public in a recent lawsuit.
