11th Circ. Upholds Toss Of Crash Claims Over Venue

Law360, New York (October 9, 2009, 5:54 PM EDT) -- An appeals court has upheld the dismissal of a massive wrongful death lawsuit stemming from a deadly 2005 West Caribbean Airways SA flight that crashed in Venezuela and killed all 160 people aboard.

In declaring the case properly dismissed, the U.S. Court of Appeals for the Eleventh Circuit agreed with a lower court that the suit would have been better filed in a different venue, according to the opinion filed Thursday.
