Suit Over Allegan Breast Implant Ruled Preempted

Law360, New York (October 16, 2009, 2:47 PM EDT) -- Saying the case was preempted by federal law, a judge has dismissed a lawsuit brought by a woman who alleged that her breast implant leaked silicone because it was negligently manufactured by a company later acquired by Allergan Sales LLC.

In a decision Wednesday, Judge G. Murray Snow of the U.S. District Court for the District of Arizona dismissed the lawsuit brought by Karen and Robert Williams against Allergan and Inamed LLC, which Allergan acquired in 2006.
