Sens. Balk At Patent Reform Act Review Provisions

Law360, New York (October 16, 2009, 6:31 PM EDT) -- Twelve Republican senators have signed a letter saying that although the Patent Reform Act has been greatly improved since its initial introduction, it still needs additional work before being brought to the floor.

The one-page letter was sent Thursday to Senate Majority Leader Harry Reid, D-Nev., and Senate Minority Leader Mitch McConnell, R-Ky.

It said the Patent Reform Act included new and expanded mechanisms for the administrative re-examination of patents, and that these post-grant review provisions were quite problematic as currently drafted.
