Calgon Carbon Tells Del. Justices Records Ruling Was Flawed

Law360 (July 15, 2020, 6:30 PM EDT) -- Calgon Carbon Corporation told the Delaware Supreme Court on Wednesday that a state court abused its discretion by ordering it to turn over records related to its $1.3 billion merger with a Japanese company, asserting "misconduct" during the case should have led to the suit being tossed.

During oral arguments on Calgon's appeal of a Chancery Court decision last year directing the company to turn over records to investor Inter-Local Pension Fund GCC/IBT, counsel for the infiltration system maker contended that the case should have been tossed due to a "course of misconduct" by the pension fund and its counsel....
