Gen-Probe Hits Becton Dickinson With Test Patent Suit

Law360, New York (October 20, 2009, 5:49 PM EDT) -- The maker of nucleic acid tests used to diagnose diseases has sued medical technology company Becton Dickinson & Co., accusing it of infringing a number of patents related to a diagnostic system.

In a lawsuit filed Monday in the U.S. District Court for the Southern District of California, biotechnology company Gen-Probe Inc. said Becton Dickinson is infringing on its patents that encompass and facilitate the use of “fully automated, highly throughput systems” for detecting infectious microorganisms and diagnosing human diseases.
