DC Circ. Says Tyson Unit 'Botched' Handling Of Union Drive

Law360 (July 24, 2020, 5:36 PM EDT) -- The D.C. Circuit on Friday agreed with the National Labor Relations Board that a Tyson Foods unit solicited workers to pull support for a union amid a "botched" response to an organizing drive, upholding the labor board's mandate that the company read employees a notice copping to the violation.

While informing workers of their right to pull their support for a union, which AdvancePierre did, isn't forbidden by the National Labor Relations Act, it can still break the law "within a perilous atmosphere created by contemporaneous" unfair labor practice violations, a three-judge panel said.
