8th Circ. Won't Rethink Food Packaging Co.'s Antitrust Suit

Law360 (July 28, 2020, 9:03 PM EDT) -- The Eighth Circuit isn't interested in revisiting its choice not to revive a suit accusing a microwavable food packaging company of using sham patent litigation and shady business tactics to build and solidify a monopoly in the industry.

The panel declined Tuesday to have the original panel or a full bench rehear the matter in a one-sentence order.

In doing so, the appellate court is putting to rest arguments from Inline Packaging LLC — a smaller packaging rival — that its decision created a rift between the circuits and with the Supreme Court.
