Ark. High Court To Take Up AEP Plant Approval Case

Law360, New York (October 22, 2009, 5:15 PM EDT) -- The Arkansas Supreme Court said Thursday it would hear a group of landowners' case about a $1.6 billion power plant being built by a subsidiary of American Electric Power Co. Inc. after a lower court ruled the state's public utilities commission improperly approved the facility.

The Supreme Court granted requests for review filed by AEP subsidiary Southeastern Electric Power Co. and the Arkansas Public Service Commission, after the Arkansas Court of Appeals in June overturned the commission's decision to sign off on the 600-megawatt coal-fired plant....
