Age Bias Suit Against Klockner Pentaplast Revived

Law360, New York (October 23, 2009, 4:29 PM EDT) -- A federal appeals court has revived an age discrimination lawsuit against plastic film producer Klockner Pentaplast of America Inc. after finding that the facts did not warrant summary judgment.

The U.S. Court of Appeals for the Fourth Circuit reversed and remanded a lower court ruling for the company Thursday, finding that a jury could conclude that the plaintiff's age was behind his firing in 2005.
