ITC To Fight Spansion Stay Order

Law360, New York (October 26, 2009, 4:14 PM EDT) -- Following in the footsteps of Samsung Electronics Co. Ltd., the U.S. International Trade Commission is appealing a bankruptcy judge's decision to stay an infringement complaint the electronics giant filed before the ITC against bankrupt Spansion Inc.

On Friday the ITC filed a notice of appeal in the U.S. Bankruptcy Court for the District of Delaware, signaling its intention to challenge Judge Kevin J. Carey's decision that the automatic stay in Spansion's bankruptcy applies to the ITC action.
