U.S. Election Could Affect Controversial Patent Policy

Law360, New York (November 6, 2006, 12:00 AM EST) -- A Democratic takeover of the U.S. House of Representatives on Tuesday could deal a blow to broadly criticized efforts by the U.S. Patent and Trademark Office to change continuing application procedures, observers say.

The proposed rule change, which has been assaulted by the biotech industry in particular, had originally been scheduled for implementation in December. However, the USPTO has backed off from its original schedule, and changing political alignments in Washington could make the rule changes much more difficult to carry out.
