10th Circ. Finds TMJ Implant Maker Liable For Penalties

Law360, New York (October 27, 2009, 7:28 PM EDT) -- A manufacturer of temporomandibular joint implants and its president are on the hook for monetary penalties after an appeals court affirmed a ruling that they knowingly failed to submit required medical device reports.

In a ruling Tuesday, the U.S. Court of Appeals for the Tenth Circuit upheld a final decision by the U.S. Department of Health and Human Services’ Departmental Appeals Board affirming determinations by an administrative law judge that TMJ Implants Inc. and Dr. Robert Christensen were each liable for penalties of $170,000.
