Minn. Fights To Move Climate Fraud Suit Back To State Court

Law360 (September 11, 2020, 6:37 PM EDT) -- Minnesota accused Exxon Mobil Corp. on Thursday of twisting the state's suit accusing industry players of deceiving consumers about climate-change-related risks into "something unrecognizable" in an attempt to force the litigation to play out in federal court.

The state argued in a memorandum Thursday that none of the arguments claiming federal jurisdiction made by Exxon in its notice of removal have any basis in reality. The state urged the court to send its suit, which also targets Koch Industries Inc. and the American Petroleum Institute, back down to state court and force the oil industry actors to pay the legal bills...
