Travelers Cleared In Faulty Construction Coverage Row

Law360, New York (October 28, 2009, 2:32 PM EDT) -- A federal judge has granted summary judgment for defendant Travelers Indemnity Co. in an insurance fight with Mosser Construction Inc. stemming from an underlying suit over failed structural backfill at a wastewater facility.

Judge Jack Zouhary's ruling, issued Tuesday in the U.S. District Court for the Northern District of Ohio, found a policy exclusion in the commercial general liability policies to be unambiguous and ruled that backfill supplier Gerken Materials Inc. did not perform subcontract work under policies capped at $2 million.
