6th Circ. Takes Law Firm's Side In Malpractice Suit

Law360 (October 29, 2009, 12:46 PM EDT) -- Ohio-based Lane Alton & Horst LLC has prevailed in National Union Fire Insurance Co. of Pittsburgh, Pa.'s appeal of a court's dismissal of its malpractice suit against the law firm and a partner.

The U.S. Court of Appeals for the Sixth Circuit affirmed summary judgment for Lane Alton in a three-page order issued Wednesday, citing for its reasoning a July ruling by Ohio's highest court that a law firm could neither commit malpractice directly nor be held vicariously liable absent a finding of liability against a firm attorney.
