Metadata Is A Public Record: Ariz. High Court

Law360, New York (October 29, 2009, 6:15 PM EDT) -- Arizona’s high court concluded on Thursday that metadata, hidden computer information generated in creating documents, constitutes a public record, handing a victory to a Phoenix police officer who sued the city to retrieve the data for an employment complaint.

In a unanimous decision, the Supreme Court of Arizona held that, under the state’s public records laws, any entity that maintains public electronic records must disclose them along with embedded metadata.
