No Coverage For Cinergy Clean Air Act Woes

Law360, New York (October 30, 2009, 5:47 PM EDT) -- An Indiana appeals court has upheld a summary judgment ruling for several insurers in a dispute with Cinergy Corp. and Duke Energy Corp. over coverage for alleged violations of the Clean Air Act.

The Indiana Court of Appeals on Wednesday ruled that insurers including St. Paul Surplus Lines Insurance Co., Travelers Casualty & Surety Co. and Associated Electric & Gas Insurance Services Ltd. have no obligation to defend, indemnify or otherwise provide coverage for energy companies in Clean Air Act litigation.
