3rd Circ. Strikes Down Abortion Clinic Protester Law

Law360 (November 2, 2009, 3:15 PM EST) -- A federal appeals court has deemed a Pittsburgh law curbing anti-abortion demonstrations outside clinics unconstitutional, finding that the two restrictive zones it creates around health facilities limit too much speech.

The U.S. Court of Appeals for the Third Circuit on Friday reversed a lower court's decision that denied a preliminary injunction to an abortion protester who challenged the law.

Because the Third Circuit decided the case on its merits, the Friday decision permanently enjoins Ordinance No. 49.
