Werner Drivers Denied Class Status In Wage Suit

Law360, New York (November 4, 2009, 3:17 PM EST) -- Two Werner Enterprises Inc. truck drivers have lost their bid for class certification in a wage suit alleging that the transport company shortchanged tens of thousands of drivers by improperly calculating the miles they traveled on the job.

Adopting the recommendations of a magistrate judge who heard arguments on the plaintiffs' class status bid in June, Judge Joseph Bataillon of the U.S. District Court for the District of Nebraska ruled Monday that the claims of the massive putative class were too individualized to justify certification....
