9th Circ. To Hear Catholic League Case En Banc

Law360, New York (November 6, 2009, 4:44 PM EST) -- A federal appeals court has agreed to hear en banc a case the Catholic League for Religious and Civil Rights brought over a nonbinding San Francisco resolution condemning a church leader who opposed adoption by same-sex couples.

Chief Judge Alex Kozinski announced on Thursday that upon the vote of a majority of nonrecused active judges, the U.S. Court of Appeals for the Ninth Circuit has decided to hear the case en banc, and the unanimous decision of a three-judge panel affirming a dismissal of the case...
