Delaware Wants Climate Suit Sent Back To State Court

Law360 (November 20, 2020, 7:27 PM EST) -- Delaware on Friday asked a federal court to remand its suit seeking to force fossil fuel companies to pay for climate change-related costs, the latest salvo in a jurisdictional tug-of-war between local governments and big energy companies about the proper venue for such disputes.

Delaware said its suit brought only state-based claims that did not raise any federal issues that would necessitate removal as the energy companies including Chevron Corp. and ExxonMobil Corp. have alleged. Energy companies across the country have been fighting to keep similar suits in federal court, while local governments want them in state court.
