EPA To Rule Quickly On Ky. Power Plant Challenge

Law360, New York (November 16, 2009, 3:42 PM EST) -- The U.S. Environmental Protection Agency has agreed to immediately rule on the Sierra Club's challenge to an operating permit for a coal-fired power plant in Kentucky, resolving a lawsuit brought by the environmental group.

According to a consent decree filed Friday in the U.S. District Court for the District of Columbia, the EPA will decide by Dec. 15 whether to grant the petition, which relates to East Kentucky Power Cooperative Inc.'s William C. Dale Power Station near Ford, Ky.
