Vioxx Class Action Approved In Quebec

Law360, New York (November 13, 2006, 12:00 AM EST) -- A Quebec court has given its stamp of approval for the first personal-injury class action in North America against Merck & Co. over the painkiller Vioxx.

Quebec Superior Court Judge André Denis authorized the lawsuit last Thursday for Quebec residents who allegedly suffered damages from the use of the drug between Oct. 1999 and Sept. 2004.

Denis declined to include Vioxx users who took the medicine but have not alleged harm, which is a bright spot for the pharmaceutical company in the case.
