11th Circ. Rejects HealthSouth Exec Sentence Again

Law360, New York (November 17, 2009, 12:49 PM EST) -- For the fourth time, a federal appeals court has vacated the sentence of the former assistant controller of HealthSouth Corp., this time saying the sentence of probation was unreasonably lenient in light of his role in the fraud.

In a decision Monday, a three-judge panel of the U.S. Court of Appeals for the 11th Circuit again vacated the five-year probation sentence of Kenneth K. Livesay. The appellate court said that any sentence of probation would be unreasonable.
