Seller Of Fake Cancer Drugs Loses Bid For New Trial

Law360, New York (November 17, 2009, 4:38 PM EST) -- A federal judge has refused to grant a new trial to an alleged doctor impersonator who was convicted of mail fraud and violating the Federal Food, Drug and Cosmetic Act for selling fake cancer-treating drugs.

Judge George O'Toole Jr. of the U.S. District Court for the District of Massachusetts denied the motion of Thomas Ronald Theodore on Friday after Theodore argued his original attorney ignored evidence. But Judge O'Toole found the evidence, even if submitted during the trial, would not crack the government's rock-solid case....
