Importer Seeks Lower Duty On Vitamin Pills

Law360, New York (November 17, 2009, 5:37 PM EST) -- Roche Vitamins Inc. has moved for summary judgment in its efforts to reclassify under the Harmonized Tariff Schedule a stabilized beta-carotene diet supplement that U.S. Customs and Border Protection categorized under the food product catch-all “other” subheading, which carries a high duty rate.

In the U.S. Court of International Trade on Monday the vitamin importers argued that the beta-carotene product should be classified either as a synthetic coloring matter, which carries a duty rate of 3.1 percent ad valorem, or as a provitamin free from duties...
