Cannabis Beer Can't Be Trademarked: EU Court

Law360, New York (November 20, 2009, 4:54 PM EST) -- A European court has ruled the word "cannabis" cannot be used as a valid trademark in connection with alcoholic beverages because the mark is descriptive.

On Thursday, the Court of First Instance of the European Communities rejected the arguments of Giampietro Torresan, a resident of Switzerland who said the mark was distinctive because it does not normally bear any connection to beer or alcoholic beverages.
