4th Circ. Lets Arbitration Award Against PPG Stand

Law360, New York (November 20, 2009, 6:27 PM EST) -- A federal appeals court has upheld an arbitration ruling that came down against PPG Industries in its contract dispute with a chemical workers union by finding that striking employees were entitled to bonuses.

The U.S. Court of Appeals for the Fourth Circuit on Friday reversed a lower court’s vacatur of the arbitration award, holding that even if the arbitrator erred by adding a term to the underlying collective bargaining agreement, he acted within the scope of his authority under the contract.
