Hospital Operator Takes UPMC Antitrust Suit To 3rd Circ.

Law360, New York (November 23, 2009, 6:10 PM EST) -- West Penn Allegheny Health System Inc. is challenging a trial court's decision to throw out its suit accusing fellow hospital operator University of Pittsburgh Medical Center and health insurance company Highmark Inc. of violating the Sherman Act.

WPAHS filed its notice of appeal on Friday in the U.S. District Court for the Western District of Pennsylvania, saying it wanted the U.S. Court of Appeals for the Third Circuit to review the lower court's Oct. 29 decision granting UPMC and Highmark's motions to dismiss.
