Delaware District Court Judge Upholds Decision Favoring Atrium Medical In Patent Suit

Law360 (April 24, 2004, 12:00 AM EDT) -- A U.S. District Court judge has upheld a decision favoring Atrium Medical Corp. in a patent lawsuit brought by Genzyme Corp.

Delaware district court Judge Mary Pat Thynge upheld the decision following a lengthy judgment review by the court, Atrium Medical Corp. said.

A unanimous jury decision had previously found that Atrium's ExpressDry Suction Chest Drains did not infringe the five chest drain medical device patents which were litigated by Genzyme.

The jury also found that all five of the Genzyme patents are invalid.
