Wis. Residents Claim Partial Win In Ethanol Plant Row

Law360, New York (November 30, 2009, 2:51 PM EST) -- A federal judge has granted partial summary judgment to a group of Wisconsin residents claiming that Didion Ethanol LLC violated the Clean Water Act by polluting nearby lakes and creeks with wastewater.

Judge Barbara Crabb of the U.S. District Court for the Western District of Wisconsin granted summary judgment on Nov. 24 in favor of the residents on three claims, but found that five remaining issues — including whether Didion violated zinc effluent limits of its permit — were not yet ripe for decision.
