9th Circ. Hears Allied's Antitrust Appeal Against Tyco

Law360, New York (December 8, 2009, 5:08 PM EST) -- The U.S. Court of Appeals for the Ninth Circuit heard oral arguments Tuesday in Allied Orthopedic Appliances Inc.'s appeal of unfavorable rulings in a putative class action accusing Tyco Health Care Group LP of stunting competition in the medical device market.

Allied is appealing the U.S. District Court for the Central District of California's July 2008 summary judgment ruling in favor of Tyco and its December 2007 denial of class certification, according to an August 2008 notice of appeal.
