DC Circ. Affirms Sureties' Win In Contractor Spat

Law360, New York (December 1, 2009, 4:23 PM EST) -- A federal appeals court has upheld a summary judgment victory for two sureties in a suit brought by Hunt Construction Group Inc. accusing the companies of defaulting on a $1.96 million performance bond after subcontractor National Wrecking Corp. breached Hunt's construction contract.

The U.S. Court of Appeals for the District of Columbia Circuit on Friday found that, because Hunt failed to alert U.S. Surety Co. and XL Reinsurance America Inc. of the subcontractor's breach until five months after the original default, the district court appropriately dismissed...
