Footwear Importer Challenges Sex-Based Duty Rates

Law360, New York (December 2, 2009, 6:06 PM EST) -- Footwear importer Deckers Outdoor Corp. has filed a lawsuit in the U.S. Court of International Trade alleging that U.S. Customs and Border Protection violated the Constitution by assessing different duty rates for men's and women's products.

Deckers lodged its suit Wednesday, naming the United States as a defendant and challenging “the assessment of duties ... at a duty rate for one gender ... that is higher than same product for the other gender.”
