Gas Royalty Cases Halted For Definition Of 'Marketable'

Law360, New York (December 4, 2009, 5:20 PM EST) -- A federal judge presiding over three royalty battles between Oklahoma landowners and gas companies has put the suits on hold while the parties ask a state appellate court what “marketable” means, an issue that may determine the outcome of the suits.

Judge David Russell of the U.S. District Court for the Western District of Oklahoma instructed the parties to confer to approve questions on when gas is “marketable” for submission to the Oklahoma Supreme Court. The definition, apparently never addressed under Oklahoma state law, may decide...
