Cephalon Sues Teva Over Plan For Generic Nuvigil

Law360, New York (December 7, 2009, 7:15 PM EST) -- Cephalon Inc. has hit Teva Pharmaceuticals USA Inc. with an infringement suit, alleging that Teva's plan to create a generic version of Cephalon's narcolepsy drug Nuvigil infringes three patents.

In a suit filed Wednesday in the U.S. District Court for the District of Delaware, Cephalon claims that it received a letter from Teva on Oct. 19 stating that the generics maker had filed an abbreviated new drug application for generic Nuvigil.
