Actavis Loses Bid To Toss Generic Reglan Claim

Law360, New York (December 8, 2009, 7:18 PM EST) -- Generic drugmaker Actavis Inc. has lost a bid to get out of a lawsuit that claims that generic versions of the anti-heartburn medication Reglan can cause an incurable neurological disorder.

Chief Judge Robert J. Conrad Jr. in the U.S. District Court for the Western District of North Carolina on Monday agreed with a magistrate judge, who earlier had thrown out a motion by Actavis to dismiss the case and denied a motion for judgment on the pleadings by co-defendant Pliva USA Inc.
