Kmart Wins Whistleblower Suit

Law360, New York (November 20, 2006, 12:00 AM EST) -- A federal judge in Michigan has granted summary judgment to Kmart Holding Corp. in a case brought by a former employee alleging his termination violated the whistleblower provision of the Sarbanes-Oxley Act.

Judge Avern Cohn said in the memorandum on the judgment Wednesday that the plaintiff, Ronald Sussberg, failed to show a causal link between what he claimed was protected activity and his termination.
