Appeals Court Rejects FERC Rules

Law360 (November 21, 2006, 12:00 AM EST) -- A heightened effort by the Federal Energy Regulatory Commission to intervene in the natural gas market has been denied by a federal appeals court, which vacated several FERC orders regarding pipeline companies and their marketing affiliates.

The U.S. Court of Appeals for the District of Columbia Circuit sided with the National Fuel Gas Supply Corporation, granting the company’s petition to strike down five FERC orders as applied to natural gas pipelines, and sending the case back to FERC for reconsideration.
