Fed. Circ. Nixes VA Nurses' Equal Pay Suit

Law360, New York (December 15, 2009, 3:17 PM EST) -- A federal appeals court has ruled that the U.S. Court of Federal Claims correctly dismissed a lawsuit brought by a group of predominantly female nurse practitioners accusing the U.S. Department of Veterans Affairs of paying them less than a mostly male group of physician's assistants doing similar work.

The U.S. Court of Appeals for the Federal Circuit on Monday upheld the earlier ruling of Judge Christine Miller, who found that mixed-sex classes of individuals cannot bring claims under the Equal Pay Act.
