Law360, New York (December 16, 2009, 7:29 PM EST) -- Industrial Enterprises Inc. is appealing a district court's refusal to force Penn America Insurance Co. to indemnify it for $750,000 it says it spent on a remedial investigation of a dump site the U.S. Environmental Protection Agency was attempting to classify as a Superfund site under the Comprehensive Environmental Response, Compensation and Liability Act.
