Kimball Claims Byrd Amendment Bars Free Speech

Law360, New York (December 17, 2009, 5:40 PM EST) -- Indiana-based Kimball Furniture Group Inc. has lodged the latest in a string of suits alleging U.S. international trade regulations violate free speech by granting anti-dumping proceeds only to those parties that supported the duties before they were implemented.

In a suit filed Wednesday in the U.S. Court of International Trade, bedroom furniture maker Kimball said it should be eligible for a share of the proceeds from anti-dumping duties imposed in 2004 on furniture imports from China, as all “affected domestic producers” are under U.S. trade laws....
