8th Circ. Shoots Down Qwest's Bid In Rate Fight

Law360, New York (January 4, 2010, 1:27 PM EST) -- A federal appeals court has upheld a lower court's finding that regulators in Nebraska did not violate a federal mandate when they modified the rates Qwest Communications Co. LLC can charge competitors for access to its local telephone networks.

However, the three-judge panel of the U.S. Court of Appeals for the Eighth Circuit remanded the case to the district court for further proceedings to determine how the rates set by the Nebraska Public Service Commission will be implemented.
