Baptist Health, Blue Cross Off Hook In Antitrust Suit

Law360, New York (January 5, 2010, 5:54 PM EST) -- A federal appeals court has upheld a victory for Arkansas hospital network Baptist Health and a Blue Cross health insurance affiliate, in an antitrust dispute pitting physician-owned facilities against major insurers and hospital owners.

The district court did not err in dismissing the antitrust allegations on the ground that the plaintiffs' alleged relevant market was legally flawed and that they did not state a plausible antitrust claim, a three-judge panel ruled in the U.S. Court of Appeals for the Eighth Circuit on Dec. 29.
