Arch Coal Mountaintop Mine Case Stayed Again

Law360, New York (January 5, 2010, 6:03 PM EST) -- Due to ongoing discussions between the U.S. Environmental Protection Agency and a subsidiary of Arch Coal Inc. over the permit at issue, the judge overseeing an environmental group's legal challenge to a 2,278-acre mountaintop removal coal mine in West Virginia has stayed the case for an additional 60 days.

Judge Robert C. Chambers of the U.S. District Court for the Southern District of West Virginia on Tuesday granted the unopposed motion to extend the stay, which has been in effect since September.
